These Terms apply to your access to and use of www.garagerebel.com (the “Website” or “Site”), including any content, functionality, and services offered through the Site.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

RELATED SITE POLICIES & CONFLICT ORDER

These specific Terms of Use govern general website access and user behavior. All transactions, financial orders, and physical equipment purchases executed through the Site are strictly governed by our comprehensive Terms of Sale, as well as our posted store policies (Return Policy, Shipping Policy, and Privacy Policy).

If a conflict arises between these general website use terms and our transactional purchase documentation, the Terms of Sale and official store policies shall control entirely for all order-related matters.

ELIGIBILITY

ACCOUNTS AND SECURITY

Certain personalized features or order tracking utilities may require creating a secure store account. You are solely responsible for:

  • Keeping your personal account login credentials strictly confidential.

  • All actions, orders, and activities that occur directly under your user account.

  • Providing completely accurate, current, and true account registration information.

USER-GENERATED CONTENT (REVIEWS, COMMENTS, UPLOADS) 

If you submit content to the Site (including product reviews, questions, comments, workspace photos, or videos) (“User Content”), you represent and warrant that:

  • You own the content or possess all legal rights needed to submit it.

  • Your content is accurate, authentic, and truthful to the best of your knowledge.

  • Your content does not violate any local laws or third-party intellectual property rights.

License to Garage Rebel: By submitting User Content, you grant Garage Rebel a non-exclusive, worldwide, royalty-free, perpetual, transferable, and sublicensable license to use, host, store, reproduce, modify, adapt, publish, translate, distribute, publicly display, and create derivative works from such User Content in connection with operating, marketing, and improving the Site and our brand business across any media.

Content Removal: We reserve the right to remove, edit, or refuse to post User Content at any time for any reason, including violations of these Terms, suspected spam, or internal quality control.

FEEDBACK AND SUBMISSIONS

If you send us product suggestions, structural ideas, general feedback, or optimization recommendations (collectively, “Feedback”), you agree we may use that Feedback without restriction, compensation, or obligation to you. You grant us a perpetual, worldwide, royalty-free license to implement it for any purpose.

INTELLECTUAL PROPERTY

The Site and all structural content on it (including text, graphics, logos, brand images, custom product layouts, videos, designs, compilations, and underlying software code) are owned directly by Garage Rebel or its licensed partners and protected by United States and international intellectual property laws.

Except as expressly permitted in writing, you may not copy, modify, distribute, sell, license, reverse engineer, or create derivative works from any part of the Site without our prior written consent.

COPYRIGHT COMPLAINTS (DMCA POLICY)

If you are a copyright owner or an authorized agent and believe that any content hosted on the Site infringes your copyright, you may submit a formal notification pursuant to the Digital Millennium Copyright Act (DMCA) by contacting support@garagerebel.com with the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  2. Clear identification of the copyrighted work claimed to have been infringed.

  3.  Identification of the specific material that is claimed to be infringing and the exact URL location on our Site.

  4. Information reasonably sufficient to permit us to contact you (address, phone number, and email).
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.

PRODUCT INFORMATION (INFORMATIONAL ONLY) 

We make constant efforts to display completely accurate product technical information, technical descriptions, imagery, pricing, and active stock availability. However, typographical errors or catalog system sync delays may occasionally occur. We reserve the right to correct catalog errors or update layout content at any time without notice.

All core transaction constraints, order cancellations for extreme pricing glitches, and purchase conditions are strictly governed by the Terms of Sale.

COMMUNICATIONS (SMS & EMAIL)

If you provide your phone number or email address, you explicitly agree that we may contact you for order updates, transactional delivery coordination, customer support, and essential account-related notices. Consent to receive automated text messages is absolutely not a requirement or condition of purchase.

You agree that all agreements, notices, invoices, disclosures, and other communications that we provide to you electronically (via email, account updates, or site postings) fully satisfy any legal requirement that such communications be in writing.

TO THE FULLEST EXTENT PERMITTED BY LAW, GARAGE REBEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, COMPLETELY ERROR-FREE, SECURE, OR ENTIRELY FREE OF HARMFUL SERVERS OR COMPONENTS.

GENERAL LIMITATION OF LIABILITY 

TO THE FULLEST EXTENT PERMITTED BY LAW, GARAGE REBEL AND ITS PARENTS, AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, COMPUTER DOWNTIME, OR REPUTATIONAL LOSS) ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO NAVIGATE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY SITE-USE CLAIM NOT INVOLVING A PRODUCT PURCHASE WILL NOT EXCEED $100 IN AGGREGATE.

SITE INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Garage Rebel and its affiliates, owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and legal expenses (including reasonable attorneys’ fees) arising out of or related to your:

  • Violation of any third-party rights or regional laws.

  • User Content you choose to submit to the platform.

TERMINATION OF SITE ACCESS

We reserve the right to suspend, restrict, or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms, used the Site unlawfully, or engaged in abusive digital behavior. Sections that by their structural nature should survive termination (including Intellectual Property, Disclaimers, Liability Limits, Indemnification, and Governing Law) shall survive completely.

GOVERNING LAW AND VENUE

These Terms of Use and all general website interactions shall be governed by, interpreted, and enforced in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. Any legal action or dispute arising under these Terms must be filed exclusively in the state or federal courts located in Florida. Any website-use claim must be brought within one (1) year after the underlying claim arises, or be forever barred.

SEVERABILITY

If any provision within these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain fully intact and enforceable.

NO WAIVER

Our failure to enforce any specific provision or right within these Terms does not constitute a waiver of our right to enforce that provision in the future.

ASSIGNMENT

You may not assign these website terms without our prior written consent. We may assign our rights under these terms in connection with a corporate merger, acquisition, or sale of business assets.

ENTIRE AGREEMENT

These Terms of Use, along with our posted Shipping Policy, Return Policy, Privacy Policy, and the Terms of Sale, constitute the entire legal agreement between you and Garage Rebel regarding your interaction with our website platform.
