These Terms of Sale (“Terms”) apply to purchases made from Infinium Capital, LLC d/b/a Garage Rebel (“Garage Rebel,” “we,” “us,” “our”) through garagerebel.com (the “Site”). By placing an order, you agree to these Terms.
These Terms govern purchases. Website use is governed by our Terms of Use.
If there is a conflict between these Terms and a product page, brand/manufacturer policy, or a written authorization we provide (e.g., RMA instructions), the following order of control applies (to the extent permitted by law):
- Product page / brand or manufacturer policy for the item
- Written authorization/instructions issued for your order (e.g., RMA instructions)
- Our Return Policy, Shipping Policy, and Price Match Policy (as applicable)
- These Terms of Sale
ELIGIBILITY & CUSTOMER RESPONSIBILITY
You confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and authorized to use the payment method provided.
It is your responsibility to:
- Review product details, requirements, and specifications before purchase
- Provide a correct shipping address and reachable phone/email for delivery coordination
- Ensure delivery access and safe receipt of your shipment
ORDER ACCEPTANCE, VERIFICATION & CANCELLATIONS
Order Acceptance: Your order is an offer to purchase. We may accept or decline an order in our discretion (for example: suspected fraud, pricing errors, stock issues, supplier restrictions, or address verification problems). If we cancel after you’ve been charged, you will be refunded to the original payment method. An order is not accepted until we confirm shipment and/or issue a tracking/PRO number.
Verification: We may request additional information to verify identity, billing, or delivery details (including confirmation of address and phone).
Cancellations/Changes
Before shipment: Some orders ship fast. You must contact us as soon as possible (within 24 hours of placing the order). Approval is not guaranteed. If cancellation is approved, a cancellation fee may apply to cover non-refundable payment processing costs and/or supplier costs. Cancellation requests must be submitted in writing to support@garagerebel.com.
After Shipment (or once a tracking/PRO number is issued): Orders generally cannot be canceled and must follow the Return Policy (if eligible).
Special Orders / Made-To-Order Items / Deposits: May be non-cancellable and non-refundable as stated on the product page or brand policy.
PRICING, PROMOTIONS, & PRICE ERRORS
Pricing: Prices may change at any time without notice. Your purchase is charged at the price shown at checkout at the time the order is placed.
Price Errors: If a product is listed at an incorrect price due to a typographical error or system/supplier error, we may cancel the order and refund any amount charged. We are not obligated to honor incorrect prices.
Promotions/Coupons: Promotions may have additional terms, exclusions, and end dates. Discounts apply to the product price only unless stated otherwise. Shipping, taxes, and accessorial fees (including freight services) are excluded unless explicitly stated.
END-USER / BRAND RESTRICTIONS
Certain products/brands may be subject to end-user restrictions (e.g., no resale). Any such restrictions will be stated on the product page or brand policy.
TAXES
Sales tax (and any required fees) may be collected based on your shipping destination and applicable law.
PAYMENT, DISPUTES & CHARGEBACKS
Billing Issues: If you believe there is an unauthorized charge or billing error, please contact us promptly at support@garagerebel.com so we can investigate and attempt resolution.
Chargebacks: We ask that you contact us before initiating a chargeback so we can help resolve the issue. If a chargeback is filed, we may:
- Provide order documentation to the payment processor (order details, delivery records, carrier communications, photos, signatures, etc.)
- Pause support on the order while the dispute is under review
- Restrict future purchases if abuse or fraud is suspected
Nothing in this section limits rights you may have under applicable law or your payment provider’s rules.
SHIPPING, DELIVERY & RISK OF LOSS
Shipping and delivery are governed by our Shipping Policy and any product/brand-specific shipping terms shown on the product page.
Key Points:
- Delivery times are estimates and not guaranteed.
- Freight deliveries may require scheduling; missed appointments, limited access, and redelivery/storage fees may apply.
- Risk of loss/responsibility transfers when the carrier marks the shipment “delivered” (or “available for pickup” at a terminal), except where otherwise required by law.
- Customers are responsible for providing a secure delivery location and inspecting deliveries as described in the Shipping Policy.
Delivery Delays: Carrier delays or events outside our control (weather, holidays, terminal backlogs, labor disruptions, acts of government, etc.) are not grounds for cancellation or refunds, except where required by law.
Installation / Third-Party Services: Unless explicitly stated in writing by Garage Rebel, products sold on the Site do not include installation, assembly, electrical work, mounting, or other professional services. Any installers, contractors, or service providers you hire (including any referrals we may provide as a courtesy) are independent third parties and are not employees, agents, or subcontractors of Garage Rebel. We do not control, supervise, or guarantee their work, pricing, licensing, insurance, permits, scheduling, or performance. Any agreement for installation or services is solely between you and the third-party provider, and Garage Rebel is not responsible for damages, delays, or disputes arising from third-party services.
DELIVERY INSPECTION, DAMAGE, MISSING OR WRONG ITEMS
Damage and shortage rules are governed by our Shipping Policy and Return Policy, plus any brand/manufacturer procedures.
Freight/LTL: You must inspect before signing the delivery receipt/BOL. Visible damage or missing cartons must be noted on the BOL and documented with photos/video. Signing without notes may limit or void freight claims.
Reporting Window: Issues such as damage, missing parts, wrong items, or delivered-not-received must be reported within the timelines in our Shipping Policy (including the 48-hour reporting window).
Delivered / Not Received (DNR/DNF): If tracking shows “delivered” but you did not receive the package, we may require a carrier investigation and additional documentation (such as a signed affidavit and/or a police report, as applicable) before a refund or replacement is considered.
RETURNS, REFUNDS & RESTOCKING
Returns and refunds are governed by our Return Policy and any product/brand-specific return rules shown on the product page.
Key Points:
- Most returns require prior written authorization (RMA/RAN) and must meet condition requirements.
- Restocking fees may apply (varies by supplier/brand) and may be significant for freight/large items.
- Outbound shipping is non-refundable; “free shipping” may be deducted from refunds where permitted by law.
- Refunds are issued only after the return is received and inspected and supplier credit is approved when applicable.
Refund Basis / Price Changes:
- Any approved refund is based on the amount actually paid on the original order (after discounts/promotions), not the item’s current price.
- Except as outlined in our Price Match Policy, we do not offer price adjustments for items that change price after purchase.
- If a price match is approved, any eligible return/refund is calculated based on the adjusted amount actually paid.
MANUFACTURER WARRANTIES; NO ADDITIONAL WARRANTIES BY GARAGE REBEL
Most products include a manufacturer warranty (terms vary by brand and by intended use, e.g., residential vs commercial). Warranty details may appear on the product page or manufacturer documentation.
Intended Use / Warranty Eligibility: Manufacturer warranty coverage may vary based on intended use (e.g., residential vs. commercial) and may be affected by installation, modification, misuse, or resale. Customers are responsible for reviewing warranty terms on the product page and/or manufacturer documentation before purchase.
Garage Rebel does not provide any additional warranties beyond the manufacturer’s warranty. To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.
PRODUCT SAFETY & WARNING (INCLUDING CALIFORNIA PROP 65)
Some products we sell may include safety warnings required by law, including California Proposition 65 notices for California customers. Where applicable, these warnings will appear on the product page (or via a clearly marked “WARNING” link) and/or on product packaging and documentation. Please review all product warnings and instructions before purchase and use. If you have questions about a warning shown on a product page, contact us before ordering.
LIMITATION OF LIABILITY
To the fullest extent permitted by law:
- Garage Rebel is not liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to your purchase or use of the products.
- Our total liability for any claim related to an order is limited to the amount you actually paid to Garage Rebel for the product(s) giving rise to the claim (after discounts), except where such limits are prohibited by law.
Some jurisdictions do not allow certain limitations, so these limitations may not apply to you.
FORCE MAJEURE
We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier delays, severe weather, natural disasters, labor disruptions, supply constraints, acts of government, war, terrorism, pandemics, or system outages.
GOVERNING LAW & VENUE
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute shall be brought in state or federal courts located in Florida, unless otherwise required by applicable law.
SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
NO WAIVER
Our failure to enforce any provision does not waive our right to enforce it later.
ENTIRE AGREEMENT
These Terms, together with our posted policies and any written instructions issued for your order, constitute the entire agreement regarding your purchase.
UPDATES
We may update these Terms at any time. Changes apply to new orders placed after the effective date listed above.
